Australian regulators are raising the stakes for Work Health and Safety (WHS) compliance. Record-breaking fines, more aggressive prosecutions, and increased accountability for individuals are all hallmarks of a stricter enforcement regime. For businesses, this shift represents not just a legal challenge but a critical call to action: rethink how safety is managed, integrated, and valued.

WHS compliance is no longer just about ticking boxes. Businesses need systems that go beyond paperwork to embed safety into the heart of their operations. The difference between organisations that merely comply and those that embrace safety as part of their culture is stark—and the consequences are real.

To help businesses understand this transformation, FCW Lawyers developed a diagnostic model outlining five stages of safety maturity. This model provides a framework for assessing where your organisation stands and how to progress. At the extremes, organisations can fall into either a responsive or culture-driven safety regime—two radically different approaches with equally dramatic outcomes.

FCW Lawyers have developed ‘The Five Stages of Safety Maturity”

The safety maturity model identifies the following stages:

  1. Responsive: Where a business has rudimentary safety without systems that respond to safety, and where safety is not seen as part of business methodology.
  2. Emergent: Where a business has solid safety processes, but they are word and paper-heavy, and there is low operational knowledge and integration.
  3. Compliant: Where safety is integrated into business processes and meets regulatory requirements, the safety system is accessible and known, and operational safety is a known and expected skill.
  4. Preventative: Where a business adopts high-order risk management, safety is driven behaviourally throughout the business, and there is parallel investment and practice in operations and safety.
  5. Culture: Where there is a cognitive understanding and commitment to safety by operational staff that assists and grows business quality and productivity.

Another mode of Safety Culture

The Dupont Bradley Curve is another model that assesses the relationship between safety culture and operational performance. This model identifies four stages of safety maturity:

  1. Reactive – relies on instincts, people do not take responsibility, safety is a matter of chance and accidents are seen to be an inevitable par of day-to-day work
  2. Dependent – Employees regard safety as rules set by the management team. Managers assume that the accident rate will fall if employees simply follow the rules. This leadership style involves exerting pressure on employees.
  3. Independent – Employees regarding safety personally. They take responsibility for themselves and understand the underlying significance of working safely
  4. Interdependent – Safety is an integral part of a company’s DNA. Employees are responsible for themselves and others. They do not accept low standards or risks. They investigate unsafe behaviour and understand that teamwork is the only way to improve safety performance.

Why Safety Maturity Matters

Mature safety cultures are more conducive to good safety performance. The safety culture, or climate, within your organisation is the perceived value place on safety. These perceptions and beliefs can be influenced by the attitudes, values, opinions and actions of other workers in an organisation, and can change with time and circumstance.

A positive safety climate improves production, reduces compensation and insurance costs and can also:

  • Enhance employee safety knowledge and their motivation to behave safely
  • Increase the uptake of safety-related policies and programs
  • Improve employee perception of more support available from management
  • Reduce the perception amongst employees of exposure to a hazardous environment
  • Reduce the number of incidents by employees and workgroups.
